This page is a plain-English summary. The binding contract is your signed Master Service Agreement (MSA) or, if none, the default MSA referenced on your invoice.
1. What BenchFlo is
A multi-tenant SaaS platform for IT staffing operations. You sign up as a “tenant”; your users (admin, recruiter, HR, rep, consultant) access the tenant. BenchFlo is operated by Cavius Technologies.
2. Acceptable use
- One tenant per legal firm. Don't share a tenant across separate legal entities.
- Don't use BenchFlo to send unsolicited bulk email. Outbound must have a legitimate business relationship with the recipient.
- Don't upload data you don't have the right to process.
- Don't attempt to bypass tenant isolation, access other tenants' data or reverse-engineer the platform.
3. Data ownership
You own your data. We process it on your behalf under a Data Processing Addendum. You can export at any time. On termination we delete within 30 days unless compliance law requires longer retention.
4. Subscription, billing, cancellation
- Lite, Starter, Growth are month-to-month. Cancel any time for end-of-period termination.
- Scale is typically annual. See your MSA.
- Invoices are issued monthly on your signup anniversary.
- Payment is due Net 15. Overdue accounts trigger a 14-day grace before read-only mode.
5. Service levels
- Target uptime: 99.5% for Lite/Starter/Growth, 99.9% for Scale (excluding scheduled maintenance).
- Planned maintenance: announced at least 48 hours in advance, targeted off-business-hours US.
- Support response: 2 business days Lite, 1 business day Starter, same-day Growth, priority Scale.
6. AI outputs
BenchFlo uses AI models to parse JDs, score matches and tailor resumes on plans that include AI. AI output is probabilistic, always human-reviewed before it leaves the platform (we gate all outbound on recruiter approval). You are responsible for reviewing AI-generated content before sending.
7. Liability
BenchFlo's aggregate liability is capped at the amount you've paid us in the preceding 12 months. We are not liable for consequential damages (lost business, lost opportunity, data loss you could have recovered via export).
8. Termination
Either party may terminate for convenience with 30 days' notice. BenchFlo may terminate immediately for non-payment (after grace period), material breach of acceptable use, or legal requirement.
9. Changes
We may update these terms. Material changes are announced at least 30 days in advance via email to admins.
